1. Acceptance of Terms

By creating an account, purchasing SMS units, or using any developer API provided by Exwhyzee Smart Solutions Limited ("Exwhyzee"), you agree to be bound by these Terms and Conditions. If you do not agree, please discontinue using the service immediately.

2. Account Registration & Security

You agree to:

• Provide accurate, current, and complete registration information.
• Maintain the confidentiality of your account password and API secret keys.
• Promptly notify Exwhyzee of any unauthorized access or security breach.

3. Strict Anti-Spam Policy

Exwhyzee enforces a zero-tolerance policy against unsolicited text messages (SPAM). You explicitly agree NOT to send messages that:

• Are sent to individuals who have not explicitly opted in or requested communication from your organization.
• Contain deceptive, fraudulent, phishing, gambling, illicit investment schemes, or defamatory content.
• Impersonate financial institutions, government agencies, or third parties without legal authorization.
• Violate NCC (Nigerian Communications Commission) or international telecom broadcasting guidelines.

4. Sender ID Guidelines

Sender IDs must not exceed 11 alphanumeric characters. Custom corporate sender IDs (e.g., banks, schools, government bodies) are subject to KYC verification and network operator approval in accordance with telecommunications regulatory standards.

5. SMS Units & Billing

• No Expiration: Purchased SMS units have no expiration date and remain active in your wallet balance until utilized.
• Page Calculation: Standard English SMS messages contain up to 160 characters per page. Longer messages will be concatenated and billed based on standard telecommunications page increments (153 characters per sub-page).
• Network Routing: Units are deducted upon submission to carrier networks. While we maintain a 99.98% gateway deliverability rate, actual receipt depends on recipient handset status and network signal coverage.

6. Limitation of Liability

Exwhyzee Smart Solutions Limited shall not be liable for indirect, incidental, or consequential damages resulting from network operator delays, power outages on recipient handsets, or force majeure events outside our direct technological control.

7. Governing Law

These terms are governed and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes arising shall be subject to the exclusive jurisdiction of the competent courts of Nigeria.
